{"id":4962,"date":"2026-09-02T07:49:17","date_gmt":"2026-09-02T07:49:17","guid":{"rendered":"https:\/\/thetransatlanticledger.com\/?p=4962"},"modified":"2026-09-02T07:49:20","modified_gmt":"2026-09-02T07:49:20","slug":"india-rechaza-el-fallo-de-la-haya-sobre-el-tratado-de-las-aguas-del-indo","status":"publish","type":"post","link":"http:\/\/thetransatlanticledger.com\/es\/india-rechaza-el-fallo-de-la-haya-sobre-el-tratado-de-las-aguas-del-indo\/","title":{"rendered":"India rechaza el fallo de La Haya sobre el Tratado de las Aguas del Indo"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>India rechaz\u00f3 un nuevo fallo de la Corte Permanente de Arbitraje, con sede en La Haya, relativo al Tratado de las Aguas del Indo, alegando que el Tribunal carece de legitimidad jur\u00eddica y que su decisi\u00f3n no tendr\u00e1 ninguna incidencia en las acciones de India.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">El fallo de la Corte Permanente de Arbitraje, anunciado el lunes 31 de agosto de 2026, sostiene que el Tratado de las Aguas del Indo de 1960 sigue vigente. Adem\u00e1s, impuso restricciones provisionales relacionadas con el proyecto hidroel\u00e9ctrico indio de Ratle, en el r\u00edo Chenab, en Jammu y Cachemira. <\/p>\n\n<p class=\"wp-block-paragraph\">Nueva Delhi ha rechazado la decisi\u00f3n de plano; el Ministerio de Asuntos Exteriores calific\u00f3 al tribunal de \u00abpresunta Corte de Arbitraje constituida ilegalmente\u00bb y reiter\u00f3 que la decisi\u00f3n de India de suspender el tratado sigue vigente. India se ha negado sistem\u00e1ticamente a participar en el procedimiento de arbitraje, argumentando que el propio Tribunal fue constituido en violaci\u00f3n del Tratado de las Aguas del Indo. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>C\u00f3mo se lleg\u00f3 a esta situaci\u00f3n<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">El actual enfrentamiento se remonta a abril de 2025, cuando India suspendi\u00f3 el Tratado de las Aguas del Indo tras el atentado terrorista de Pahalgam. Nueva Delhi vincul\u00f3 el atentado con redes terroristas con base en Pakist\u00e1n, unas acusaciones que Pakist\u00e1n ha rechazado. La decisi\u00f3n de suspender el tratado fue extraordinaria.  <\/p>\n\n<p class=\"wp-block-paragraph\">El Tratado de las Aguas del Indo, firmado en 1960 con el Banco Mundial como intermediario, hab\u00eda sobrevivido a d\u00e9cadas de guerras, crisis diplom\u00e1ticas y hostilidades entre ambos pa\u00edses. Tras la decisi\u00f3n de India de suspender el tratado, Pakist\u00e1n impugn\u00f3 la postura india a trav\u00e9s de los mecanismos de resoluci\u00f3n de disputas previstos en el propio tratado, llevando el asunto ante la Corte Permanente de Arbitraje de La Haya. La respuesta de India desde entonces ha sido constante: no existe ning\u00fan arbitraje v\u00e1lido que reconocer. <\/p>\n\n<p class=\"wp-block-paragraph\">Esto sit\u00faa a ambas partes en posiciones jur\u00eddicas fundamentalmente distintas. Pakist\u00e1n sostiene que el tratado sigue siendo vinculante y que el arbitraje internacional puede resolver las disputas que surjan en su marco. India sostiene que el Tribunal nunca fue constituido de forma v\u00e1lida y que, por tanto, no puede imponer obligaciones a Nueva Delhi.   <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>Lo que decidi\u00f3 el Tribunal<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">El Tribunal rechaz\u00f3 el argumento de India de que pod\u00eda suspender el tratado y concluy\u00f3 que el acuerdo sigue plenamente vigente. Asimismo, dict\u00f3 medidas provisionales relativas al proyecto hidroel\u00e9ctrico de Ratle, restringiendo determinadas actividades de construcci\u00f3n mientras contin\u00faa, en paralelo, el proceso con expertos neutrales. Se espera una decisi\u00f3n definitiva de ese proceso hacia julio de 2027.  <\/p>\n\n<p class=\"wp-block-paragraph\">La disputa resulta relevante porque el tratado otorga a Pakist\u00e1n los derechos principales sobre los r\u00edos occidentales \u2014el Indo, el Jhelum y el Chenab\u2014, mientras que otorga a India derechos sobre los r\u00edos orientales Ravi, Beas y Sutlej, con derechos limitados de uso sobre las aguas de los r\u00edos occidentales. Durante m\u00e1s de seis d\u00e9cadas, este acuerdo ha sido uno de los pocos tratados funcionales entre India y Pakist\u00e1n, y un referente de cooperaci\u00f3n internacional. <\/p>\n\n<h3 class=\"wp-block-heading\"><strong>El conflicto de fondo<\/strong><\/h3>\n\n<p class=\"wp-block-paragraph\">El reciente fallo va, por tanto, mucho m\u00e1s all\u00e1 de la cuesti\u00f3n de una presa. La Haya sostiene que el tratado sigue vinculando a India. Nueva Delhi sostiene que el Tribunal carece de autoridad para hacer tal determinaci\u00f3n, sin que ninguna de las dos partes est\u00e9 dispuesta a salvar esa brecha.   <\/p>\n\n<p class=\"wp-block-paragraph\">El proyecto de Ratle se ha convertido en un punto especialmente sensible porque se ubica en el r\u00edo Chenab, uno de los r\u00edos occidentales asignados principalmente a Pakist\u00e1n en virtud del tratado. India considera el desarrollo hidroel\u00e9ctrico en Jammu y Cachemira como una parte importante de su estrategia de infraestructura y energ\u00eda, mientras que Pakist\u00e1n ha cuestionado en repetidas ocasiones el dise\u00f1o y funcionamiento de este tipo de proyectos. Esto ha derivado en un enfrentamiento jur\u00eddico, que se suma a una relaci\u00f3n pol\u00edtica ya de por s\u00ed deteriorada y explosiva. <\/p>\n\n<h2 class=\"wp-block-heading\">Lo esencial<\/h2>\n\n<p class=\"wp-block-paragraph\">El Tratado de las Aguas del Indo fue dise\u00f1ado para evitar que las disputas por el agua se convirtieran en una fuente m\u00e1s de conflicto entre India y Pakist\u00e1n. Hoy, el propio tratado se ha convertido en el objeto de la disputa. La Haya sostiene que sigue vigente. India sostiene que la Corte carece de legitimidad y que su decisi\u00f3n no cambia nada.   <\/p>\n\n<p class=\"wp-block-paragraph\">Con las obras del proyecto hidroel\u00e9ctrico de Ratle en curso, es poco probable que la brecha entre la Corte Permanente de Arbitraje y la postura de India se cierre pronto. La verdadera pregunta ya no es simplemente qui\u00e9n se <em>queda con el agua<\/em>.
